question about "commercial gain"

Ok so someone has lineart available, and follows are thier rules, my question is, is SG considered commercial gain? If I dont do USD sales? (which I dont plan on anyway)

May I repost your artwork on my website?

Yes, provided you can meet the following conditions:

You may not claim the art as your own.

You may not edit out the watermark on the artwork, or change the dimensions of the image.

You may not post the art for commercial gain.

Credit must be posted nearby the image to neondragonart.com.

You may not hotlink images off my site. You must upload them to your own server to display them.

I really hope this works out to be ok, even if it means I have to promise to never ever sell SG for USD, I will totally do that. I mean, theres so many adoptables here I want, I never have SG available to sell anyway lol.

I hope it turns out ok, I spent 3 days templating this guy, and there are 7 more! Im also willing to preface every thread with "these will only be available for SG or trade for other adoptables". I just want to share them.

Just my personal opinion, but I believe SG would be commercial gain in this case.  You are making a profit if you sell them - it doesn't have to be USD to be profit, especially when you can turn around and spend the SG on something else.

The question in bold "May I repost your artwork on my website?" suggests that you will be posting as a clip art, or your own collectable pet, not that you will be selling it, for whatever currency is involved

I dunno what everyone else thinks, but since SG is the "currency" for Secundi, I would have to say that selling these guys would count as commercial gain

After checking out the website the artist says:

"for any sort of monetary gain (this includes Neopoints, Gaia points, and Warcraft gold) then you may not" SG falls into this category I believe.

technically, I think selling for sg could be seen as commercial gain.  Since, if I remember right (and its been over ten years, I may not remember right at all!) but if I do remember right, then commercial gain would include any form of currency.  Be it a dollar, a quid, a pence.. or a secund.

However, it all would come down to how the person who made the rules views it.  I would advise asking them for a clarification.  Different people could view it differently.

ok, I decided to go the 100% sure route and sent the artist an email. Ill cross my fingers and wait

Thanks for replies.. looks like these will not be ok if the artist doesnt answer.
